The Supreme Court on Thursday dismissed petitions demanding a judicial probe, led by a retired SC judge, into the recent terror attack in Pahalgam, Jammu and Kashmir, which resulted in 26 deaths.
The bench, comprising Justices Surya Kant and N Kotiswar Singh, strongly criticized the petitioners, stating that judges are not experts in terror investigations. “Be responsible while filing such PILs. You have a duty towards the country too. Is this how you want to demoralize our forces? Since when did we gain expertise in investigations?” the bench remarked.
They emphasized that judicial figures are meant to adjudicate, not investigate, and warned against filing public interest litigations that could undermine the morale of security personnel. The court advised the petitioners to withdraw the plea and explore other legal avenues.
However, the bench allowed the petitioner the liberty to approach relevant high courts to seek protection measures for students from Jammu and Kashmir studying in other states, under the respective high court jurisdictions. The court refrained from entertaining the PIL at the apex level.
