Supreme Court Blocks CBI Probe Into Bengal Govt’s Teacher Rehiring Move, Overrules High Court

The Supreme Court has ruled out a CBI investigation into the West Bengal government's move to create additional posts for around 25,000 teaching and non-teaching staff dismissed after the state's School Service Commission (SSC) recruitment process was annulled.

A bench led by Chief Justice Sanjiv Khanna overturned the Calcutta High Court’s decision, noting that courts cannot interfere with cabinet-level decisions, and deemed the High Court’s order flawed. The ruling came in response to a plea from the Mamata Banerjee-led state government.

Last week, the Supreme Court declared the SSC’s recruitment process as “tainted by manipulation and fraud,” stating that widespread malpractice had irreparably damaged its credibility. The bench observed that the large-scale corruption and efforts to conceal it made it impossible to distinguish between ‘tainted’ and ‘untainted’ candidates.

In response, Chief Minister Mamata Banerjee, gearing up for a tense electoral battle next year, vowed to stand by the "deserving" teachers. She also drew comparisons to irregularities in other states, citing the infamous Vyapam scam in Madhya Pradesh and recent exam paper leaks in NEET.

Banerjee accused both the BJP and CPI(M) of conspiring to sabotage Bengal’s education system.
