Delhi HC Orders Nationwide Crackdown on Fake Birkenstock Footwear
The Delhi High Court has initiated a widespread crackdown on the production and sale of counterfeit sandals mimicking the iconic designs of global footwear brand Birkenstock. The court ordered raids and the seizure of fake products at various locations across India, following an interim order that restrains multiple entities from manufacturing or distributing imitation Birkenstock sandals.
The German brand approached the court after discovering in March 2025 that counterfeit versions of its products were being produced and sold. Birkenstock hired third-party investigators, who identified a network of manufacturers and distributors operating primarily in rural areas around Agra, Uttar Pradesh. These counterfeit goods were reportedly being sold in markets such as Ghaffar Market, Karol Bagh, and Tilak Nagar in Delhi, and were even exported internationally.
During the probe, investigators collected photographic evidence from factories and retail outlets, clearly showing fake products that used Birkenstock’s trademarks, packaging, and signature design elements.
In its order dated May 26, the High Court noted that the knock-offs closely resembled Birkenstock's genuine products and were likely to mislead consumers. The court stated that such counterfeit items could easily deceive the public into believing they were connected to the original brand.
To address the issue effectively, the court issued a John Doe order—applying not only to named defendants but also to unidentified individuals involved in the counterfeiting. It also appointed Local Commissioners with wide-ranging authority to search, seize, and seal fake goods. If any premises were locked, the Commissioners were empowered to break open locks with police assistance.
