Although this young petitioner, after the separation of his parents, grew up with his mother-who is a member of the silver community and falls into the SC category-the court concluded that he did not suffer the social depletion that is usually associated with the SC identity.
The Division Bench made it clear that the student's upbringing, education and standard of living do not reflect the reservation to deal with which reservation has been arranged. The court also indicated that the student's mother was not facing any serious economic or social difficulty, which made his demand less justified.
This decision of the court does not question the student's mother's caste, but rather checks whether the student themselves are facing systemic obstacles that this policy wants to end.
