Chief Justice Sanjiv Khanna to review pleas against the Waqf Amendment Act. Petitioners, including MPs and clerics, argue the law violates religious rights and
Chief Justice of India Sanjiv Khanna on Monday said he'd decide on listing desires that challenge the recent emendations to the Waqf Act.
He made this comment after elderly advocate Kapil Sibal raised the issue before a Supreme Court bench headed by him. Sibal informed the court that a solicitation had been filed by Maulana Arshad Madani, chairman of the Jamiat Ulema- i- Hind, an organisation of Muslim ministers.
CJI Khanna responded by noting that the established procedure for listing matters transferring an dispatch request to the court — should be followed, and oral mentions avoided. Sibal clarified that he'd formerly transferred the dispatch, to which the CJI replied, “ It'll be placed before me in the autumn, I'll do the needful. ”
Several desires have been filed in the Supreme Court questioning the indigenous validity of the Waqf Amendment Act, which entered presidential assent on April 5.
The pleaders include MPs Asaduddin Owaisi and Mohammad Jawed, AAP MLA Amanatullah Khan, the Samastha Kerala Jem- iyyathul Ulama, and the NGO Association for Protection of Civil Rights. They argue that the law is arbitrary, discriminative on religious grounds, violates the Shariat Act, and undermines the Muslim community’s autonomy in managing religious institutions.
