UGC Releases Draft ‘Fitness of Colleges for Receiving Grants Rules, 2024’

In an effort to bring about a significant overhaul of the nation’s education system and bring the UGC regulations into compliance with NEP 2020, the higher education authority modified the previous Fitness of Institutions for Grants Rules, 1975, and made the proposed rules for 2024 available for feedback from the public.

Only if the UGC is satisfied that the college meets the following requirements will colleges be eligible for grants from the central government, the UGC, or any other organization receiving funding from the central government.

1. The college and the affiliating university are included under Section 2(f) of the UGC Act,1956.

2. The college has valid accreditation from the National Assessment and Accreditation Council (NAAC) or National Board of Accreditation (NBA) for at least 60% of the total eligible programmes for accreditation for the colleges offering more than three programmes. In case the number of programmes being offered is less than three, then each of the eligible programme must have been accredited or the college is ranked in the National Institutional Ranking Framework (NIRF) in the respective category (thrice after participating five times/twice after participating thrice).

3. The college has an Institute Development Plan to formulate its development proposals.

4. The college/ sponsoring body has adequate financial resources of its own to meet the operational requirements. The college shall submit a certificate to this effect duly endorsed by the university.

5. The college charges the students only the fees prescribed by the appropriate authority at the central/state level/university/college or as per law in force. It does not charge any capitation fees or any unauthorised fees. The college shall submit a certificate to this effect duly endorsed by the university.

6. The college shall submit an undertaking duly endorsed by the university to the effect that:

(i) Not less than 75% of the sanctioned/required as per relevant regulatory

council’s norms teaching posts are filled up at the time of submission of

application.

(ii) The teachers are paid as per UGC/state government/relevant regulatory

authority norms/pay scale, as applicable.

(iii) The reservation policy is followed as per the policy of the central or the state

government.

7. The college shall comply with all the rules/regulations/directions/notices/circulars, etc, issued by the UGC from time to time. An undertaking to this effect shall be submitted to UGC along with the application duly endorsed by the university.

8. The college affiliated to/recognised by a university, shall submit an undertaking to refund such part of the grants received by the college from the UGC and/or any other government funding agency, as may not have been properly utilised for the purpose for which they were allocated or may not have been utilised at all.

Both the College and the University shall ensure that all the provisions of the UGC Recognition of Colleges under Clause (f) of Section 2 of the UGC Act Regulations are followed in letter and spirit. Further, if required, the commission may decide on physical or virtual verification of a college or constitute teams for such verification at any stage of application or at any time during the course of recognition on its own or upon receipt of any complaint against the accuracy and veracity of the information submitted to the Commission or hosted on the website of the college or any other complaint. Failing to rectify the deficiencies pointed out after such verification, the commission may take necessary action to withdraw the recognition granted to the College under Section 2(f) and/or 12B of the UGC Act, 1956.
