President Droupadi Murmu gives approval to Haryana law declaring child marriages void

New Delhi: President Droupadi Murmu has given her assent to the legislation of Haryana under which every child marriage that has been solemnised will be considered as “void ab initio” (having no legal effect from inception), thus making a marital relationship between a man and a girl aged between 15 and 18 years illegal.

The Prohibition of Child Marriage (Haryana Amendment) Bill, 2020 was enacted following a Supreme Court ruling.

The apex court had declared that the Protection of Children from Sexual Offences (POCSO) Act, 2012, being a special law, prevails over the Indian Penal Code, 1860 and sex with a minor wife aged between 15 and 18 years, in accordance with the prevailing exception 2 of section 375 of the IPC, is arbitrary and violative of the Constitution.

Accordingly, the apex court invalidated the existing exception 2 of section 375 of the IPC, under which sexual intercourse between a man and his wife aged between 15 and 18 years does not amount to the offence of rape as defined under section 375. But according to the provisions of section 6 of the POCSO Act, this falls within the definition of rape. The Supreme Court has also observed that it would be wise for all the state legislatures to adopt the route taken by Karnataka to make child marriages void and thereby, ensure that sexual intercourse between a minor girl and her husband is a punishable offence under the POCSO Act and the IPC.

“Accordingly, the Prohibition of Child Marriage (Haryana Amendment) Bill, 2020 was enacted and the legislation has now received the presidential assent,” a home ministry official said.

The president has also given her assent to the Registration (Tamil Nadu Amendment) Bill, 2021 to further amend the Registration Act, 1908 to prevent the registration of forged documents and impersonation and to cancel registrations done on the basis of forged documents.

Following the enactment of the Bill, the registrar could issue a show-cause notice asking why a registration shall not be cancelled and on consideration of the reply, may cancel the registration and enter the cancellation in the relevant books and indices.

It has another provision that allows any person aggrieved by an order of the registrar to file an appeal with the inspector-general within 30 days of cancellation.

Currently, the provisions of the Registration Act, 1908 (Central Act XVI of 1908) do not empower the registering officer or any other authority to cancel a document once registered, even on the grounds of fraud and impersonation, causing grave hardship to those who have been cheated.

The first batch of indigenously-developed Light Combat Helicopter (LCH) named ‘Prachand’ was inducted into the Indian Air Force on Monday in the presence of Defence Minister Rajnath Singh. The induction ceremony was held in Rajasthan’s Jodhpur where newly appointed Chief of Defence Staff (CDS) Anil Chauhan was also present along with the Union Minister.

While speaking on the occasion, Singh said that LCH will enhance our capability and will boost defence production and it proves India’s commitment towards self-reliance in Defence production.

“There could not have been a better timing for LCH induction than Navratri and in the land of warriors, Rajasthan,” Singh said, adding that the LCH is a result of research and development for two decades.

“For a long time, there was a need for attack helicopters and during the 1999 Kargil war, its need was felt seriously. The LCH is a result of research and development for two decades and its induction into IAF is an important milestone in defence production,” Singh further said.

The new chopper getting inducted into the force is capable of aerial combat and will help the force combat slow-moving aircraft, drones and armoured columns during conflicts. The induction ceremony will be led by Rajnath Singh who has played a crucial role in progressing cases for buying indigenous platforms for forces.

He was also present in the Cabinet Committee on Security which cleared the purchase of 15 of these LCHs for the air force and the army.

Hailing the service of the Indian Air Force, Singh said that IAF has played an important role in the nation’s security whether it was internal threats or external war.

“IAF has always strengthened national security with their courage and bravery. The induction of indigenously developed LCH will increase the efficiency of IAF. It has always supported indigenously developed defence products like Marut, Light Combat Aircraft, Aakash Missile System, Advanced Light Helicopter and now LCH. It shows IAF’s trust towards indigenously design and development,” Rajnath Singh said.

Defence Minister also talked about the key feature of this made-in-India LCH and said it perfectly meets the needs of our armed forces.

“LCH is capable of dodging the enemy, carrying a variety of ammunition, and delivering it to the site quickly. LCH perfectly meets the needs of our armed forces in various terrains and it is an ideal platform for both our Army and Airforce,” he added.

Giving reference to the Ukraine-Russia war, Rajnath said, “The conflict or earlier conflicts teach us that heavy weapon systems and platforms, which are unable to move rapidly across the battlefield, have a low capability, and become easy targets for the enemy.”

He considered the defence of the nation as the top priority and said that the government is fully committed to it.

“I can say with full confidence that in the coming time, India will be first whenever there is talk of superpowers including military power in the world,” he said.

“For the nation’s security, it is the job of the government to ensure armed forces are equipped with the best equipment and platforms. Irrespective of the geopolitical scenario, it is their job to keep National security on alert. Against the backdrop of certain events in the past, the government has focused on indigenisation in defence production and preparedness. They are getting positive responses from services, research and development, start-ups, and public and private sector industries. All are coming together to give a new height to defence production,” Singh further said.

“Time requires to shift towards such equipment and platforms that could are easy to move, more flexible and also more lethal. I like to appreciate HAL engineers for putting all these features in LCH. And don’t get confused with the ‘Light’ word associated with it but the task it will deliver is ‘heavy’,” he said.

The light combat helicopter is a dedicated combat helicopter designed and developed indigenously in India. It has been manufactured by Hindustan Aeronautics Limited (HAL).

Of the 15 limited series production helicopters approved, 10 are for the IAF and five for the army. It can land and take off from an altitude of 5,000 metres with weapons and fuel, the officials said.

The choppers have been flown extensively in Ladakh and the desert sector to meet the requirements of the armed forces. The IAF has inducted multiple helicopters to its fleet in the last three-four years with the induction of the Chinooks, Apache attack helicopters and now the LCHs.

CCS met under the Chairmanship of Prime Minister Narendra Modi on March 30, 2022, in New Delhi. The CCS has approved the procurement of 15 Light Combat Helicopter (LCH) Limited Series Production at the cost of Rs. 3,887 Cr along with Infrastructure sanctions worth Rs 377 crore.

Light Combat Helicopter Limited Series Production (LSP) is an indigenously designed, developed and manufactured state-of-the-art modern combat helicopter containing approximately 45 per cent indigenous content by value which will progressively increase to more than 55 per cent for the SP Version.

“This helicopter is equipped with requisite agility, manoeuvrability, extended range, high altitude performance and around-the-clock, all-weather combat capability to perform roles of Combat Search and Rescue (CSAR), Destruction of Enemy Air Defence (DEAD), Counter Insurgency (CI) operations, against slow-moving aircraft and Remotely Piloted Aircraft (RPAs), high altitude bunker busting operations, Counter Insurgency operations in the jungle and urban environments and support to ground forces and would be a potent platform to meet the operational requirements of Indian Air Force and Indian Army,” said the Ministry of Defence.

Lt General Anil Chauhan (retired) had been appointed as the next Chief of Defence Staff (CDS), after the top position feel vacant with the sudden demise of Bipin Rawat following a helicopter crash on 8 December 2021. The appointment comes amid efforts by the government to give a big push to indigenisation in the equipment for defence forces.

Chauhan also became the first retired officer to be appointed to the position after the Centre’s new rules for selecting a CDS marked retired personnel as eligible. He had retired as the Eastern Army Commander in May last year and was serving as the Military Advisor to the National Security Council.

Who is a Chief of Defence Staff?

The CDS is the most senior uniformed officer in rank, the first among equals — the only four-star officers in the country are the CDS, the chiefs of the Indian Army, Indian Navy and Indian Air Force.

The CDS is also the single point of contact for the government for giving military advice and is the senior-most bureaucrat in the defence ministry which has four major departments.

Lt Gen Anil Chauhan- Early life

Born on 18th May 1961, Lt Gen Anil Chauhan was commissioned into the 11 Gorkha Rifles of the Indian Army in 1981.

He is an alumnus of the National Defence Academy, Khadakwasla and Indian Military Academy, Dehradun.

In the rank of Maj General, Anil Chauhan had commanded an Infantry Division in the critical Baramula sector in the Northern Command.

Later as Lt General, he commanded a corps in the North East and subsequently went to become the General Officer Commanding-in-Chief of the Eastern Command from September 2019 and held the charge until his retirement from the service in May 2021.

In addition to these command appointments, the officer also tenanted important staff appointments including the charge of Director General of Military Operations.

Earlier, the officer had also served as a United Nations mission to Angola.

He superannuated from the Indian Army on 31 May 2021.

New Delhi: While addressing the inaugural session of the All India Conference of Law Ministers and Law Secretaries on Saturday, PM Narendra Modi stressed the constant reforms being made in the legal system to get rid of obsolete laws and speedy trials.

PM Modi said that the government has been working incessantly for the last eight years to remove unnecessary laws and till date 32,000 compliances have been removed in these years in order to improve the ease of living.

There are many unnecessary pre-independence laws that are still in force, in the context of which PM Modi said urging the conference of the state ministers to take a review of this and to ensure ease of living and ease of justice. “Delay in justice is one of the challenges and this issue is being taken seriously,” PM Modi said. He referred to evening courts in Gujarat and how they took the load off the judiciary.

While making laws, the focus should be on simple language so that people understand the laws, PM Modi said adding the importance of local language. “Some countries also have this provision that when a law is being made, it is also determined how long the law will be in force. We should also work towards that,” PM Modi said.

The legal system should adopt a humanitarian approach and think about the undertrial prisoners sympathetically, PM Modi said urging the conference to brainstorm on speedy trials.

New Delhi: A full-page advertisement in the leading US newspaper Wall Street Journal calling out Finance Minister Nirmala Sitharaman and 10 senior government officials has stirred up a controversy Saturday. Calling them ‘Modi’s Magitsky 11’, the advertisement introduced them as officials who make India “an unsafe place to invest”. It also features a QR code at the bottom, which leads to a website of the US-based think tank Frontiers of Freedom.

Apart from Sitharaman, Antrix chairman Rakesh Sasibhushan, Solicitor General Tushar Mehta, Additional Solicitor General N. Venkatraman, Justices Hemant Gupta and V. Ramasubramanian of the Supreme Court, CBI DSP Ashish Pareek, ED director Sanjay Kumar Mishra, deputy director A. Sadiq Mohamed Naijnar and assistant director R. Rajesh, and special judge Chandra Shekhar .

The timing of the advertisement has also raised many eyebrows as Sitharaman is currently in Washington to attend the annual meetings of the International Monetary Fund and the World Bank. The finance minister, who reached Washington on 11 October, will remain there till 16 October.

“These Modi Government officials have decimated the rule of law by weaponizing the institutions of the state to settle scores with political and business rivals, making India unsafe for investors.

“We have asked the US government to impose economic and Visa sanctions against them under the Global Magnitsky Human Rights Accountability Act. Under Modi, a decline in the rule of law has made India a dangerous place to invest. If you are an investor in India, you might be next,” reads the ad’s published on 13 October.

Founded by U.S. Senator Malcolm Wallop in 1995, the Frontiers of Freedom (FF) is headed by George Landrith who has been holding the position since 1999.

On its website, the organisation describes itself as “an educational foundation” promoting the principles of “individual freedom, peace through strength, limited government, free enterprise, free markets, and traditional American values”.

Kanchan Gupta, a senior advisor at the Ministry of Information and Broadcasting, claimed that the campaign is being run by Ramachandran Viswanathan, the former CEO of Devas Multimedia.

In September, a special court in Bengaluru had allowed the Enforcement Directorate (ED) to declare Viswanathan as a ‘fugitive economic offender’ in connection with a money laundering case.

Viswanathan’s firm was caught up in a conflict with the Indian government as a contract for developing wireless broadband was cancelled in 2011.

The Bengaluru-based startup company was liquidated in May 2021 by the National Company Law Tribunal and a case was filed against US-based Viswanathan and nine others for allegedly diverting 85 percent of foreign investment worth Rs 529 crore it received after a 2005 satellite deal with the Indian Space Research Organisation (ISRO).

In August, the Frontier of Freedom had filed a petition earlier under the Global Magnitsky Human Rights Accountability Act, which authorises the US President to impose economic sanctions and deny entry into America to any foreigner identified as engaging in human rights abuse or corruption.

The document of the petition mentions that the FF is submitting the petition in cooperation with Viswanathan, on behalf of him and Devas Multimedia America Inc.

According to the petition, the FF sought “redressal of blatant abuses of authority by Indian officials who have wrongfully used India’s criminal investigation agencies and courts in a campaign to circumvent liability over a contract dispute”.

FF president George Landrith, meanwhile, tweeted the advertisement that came out on WSJ.

“The actions of Indias Magnitsky11, Sitharaman, Narendra Modi & BJP send a clear message to potential investors in India: India is a dangerous place to invest!” he said in another tweet.

New Delhi: Prime Minister Narendra Modi on Wednesday inaugurated the Defence Expo 2022 in Gandhinagar, laid the foundation stone of a new airbase at Deesa and said the new airbase will emerge as an effective centre for the country’s security. Gujarat will become a centre of defence in India and will play a crucial role in India’s security. “I was seeing on the screen that the people of Deesa were excited over the construction of the new airfield. This airfield will play a major role. Deesa is only 130km away from the International Border. If our forces, especially our airforces, remain in Deesa, then we will be able to give better response to any threat coming from the Western side,” PM Modi said addressing Deesa’s ‘brothers and sisters’ in Gujarati.

“When I was the chief minister, I worked towards the construction of the airfield. The land was allotted in 2000 only. I repeatedly urged the then Central government to start the construction as it is at a vantage point. But 14 years went on and nothing happened,” PM Modi said.

“And the files were created in such a way that even after I reached the centre, it took time to finally push the project. And now the dream of my defence personnel is coming true. I congratulate my Airforce soldiers. This will now play an important role in the country’s security,” PM Modi said.

On Mission Defence Space which is a new mission to be launched, PM Modi said all three defence forces identified several threats in this sector. And the benefits of India’s Mission Defence Space will not only be confined within India, but it will reach to many other countries.

“Eight years ago, India was identified as the world’s largest importer. But Make-in-India changed its face. Our defence expost increased eight times in the last eight years,” PM Modi said adding that the defence sector is following 3-Is: Intent, innovation and implementation.

“This export is not limited to only a few companies. Indian companies are now part of the global supply chain. Many countries are now showing interest in Tejas and our companies are supplying defence equipment parts to countries like the US and Israel,” PM Modi said.

India on Friday morning successfully test-fired ‘Agni Prime’ – a new generation of ballistic missiles – from off the coast of Odisha. Defence officials said all test objectives were met and said that the third consecutive (and successful) test of the ‘Agni Prime’ had ‘established the accuracy and reliability of the system’.

Performance was validated using data obtained by many tracking systems, including radar, telemetry and electro-optical systems, the officials said.

These systems were deployed at different locations along the flight path, including two down-range ships at the terminal point, and covered the entire trajectory, officials added.

The first test was in June last year, with the second six months later – in December. On both those occasions too the missile ‘followed textbook trajectory and met all mission objectives with a high level of accuracy’, officials said.

The ‘Agni Prime’, or ‘Agni-P’, is a nuclear-capable new-gen advanced variant of the Agni class of missiles; it is a two-stage canisterised missile with a maximum range of 2,000 km.

Significantly, it weighs 50 per cent less than the Agni 3 missile and has new guidance and propulsion systems. In addition, since it is canisterised, it can be launched from rail or road, be stored for longer periods and can be transported as per operational requirements.

The successful test of the ‘Agni Prime’ underlines India’s endeavour for its defence sector to be self-reliant.

Prime minister Narendra Modi this week hailed steps taken in that regard.

“Eight years ago India was the world’s biggest defence importer… but the ‘new India’ has shown intent and resolve to ‘Make in India’ the success story of our defence sector,” the prime minister said while inaugurating DefExpo 2022 in Gandhinagar in poll-bound Gujarat.

Belgrade: Ace grappler Bajrang Punia became the only Indian to claim four medals at the World Wrestling Championships by clinching a bronze in the current edition on Sunday. Bajrang, who won a bronze in last year’s Tokyo Olympics, eked out a close 11-9 win on points over Sebastian C Rivera of Puerto Rico in one of the bronze medal bouts.

Bajrang, who lost to John Michael Diakomihalis of USA in the quarterfinals, qualified for the bronze medal contest through the repechage round where he defeated Vazgen Tevanyan of Armenia 7-6 by points.

It is Bajrang’s third bronze in the world. The celebrated Indian wrestler had earlier won bronze at in 2013, silver in 2018, and bronze in 2019.

India had fielded a 30-member team for the ongoing World Championships but produced a below-par performance, securing just two medals.

Tokyo Olympics silver medallist Ravi Kumar Dahiya had crashed out early and failed to secure a podium finish.

Besides Bajrang, Vinesh Phogat won her second World Championship bronze medal in the women’s 53kg category.

Vinesh had defeated Emma Malmgren of Sweden 8-0 to claim the bronze here.

Former India captain Sunil Gavaskar feels that not being able to defend totals without Jasprit Bumrah has been India’s problem for long period now, and the management needs to do some course correction.

“This is India’s weakness. This isn’t a new problem. It has existed for a few years now that when they are defending, they find it difficult without Jasprit Bumrah. When Bumrah is there, the score can be defended but without him, they give away even 200-plus totals. Having said that, we need to look at the solution for it. Else, going forward, it may hurt them,” Gavaskar said on Sports Tak after the first T20I between India and Australia.

When asked about his take on Jasprit Bumrah, Gavaskar said: “About his (Bumrah’s) fitness, I feel that since he is such an important member of the team, the team management wants him to be entirely fit and only then he be picked in India’s XI. Maybe he will play in Nagpur.”

“But here is the thing. When the Indian team is chasing a target, they win matches. But it’s the opposite the other way around. The bowling that is needed between overs 16 and 20, still don’t have it. This is the reason that team is ending up on the losing side,” he added.

India and Australia will square off in the second T20I on Friday in Nagpur.

According to a report filed by Forbes, Mbappe will earn $128 million for the 2022-23 season. The former AS Monaco striker will earn the staggering sum before taxes and agents’ fees. Mbappe had penned a lucrative deal with PSG as the French forward famously turned down Real Madrid to extend his stay at the Le Parc des Princes. Snubbing Real Madrid in the summer transfer window, Mbappe signed a three-year contract extension in May.

Mbappe is expected to earn $110 million between his salary and his signing bonus for the ongoing season with PSG. The report added that Mbappe will collect $18 million in annual endorsements. The Frenchman is the face of popular brands like Nike, Dior, Hublot, Oakley and Panini. For the third time in his career, superstar Mbappe also appeared on the cover of EA Sports’ FIFA video game in 2022.
